About Intellectual property

Intellectual property is the creations of the minds of an individual which has a commercial and moral value. Intellectual property rights (IPR) grants exclusive rights to an author for utilizing and benefiting from their creation. However, IPR is limited in terms of duration, scope and geographical extent. IPR encourages creativity and permits the creator to benefit from the advantage arising out of their creation. These laws allow investors a fair return on their investments in the research and development fields.

Intellectual property also consists of a set of exclusive rights, but not for tangible things such as cars but for “intellectual works”. “Intellectual works” are creative and immaterial works such as stories, musical compositions, the shape of a piece of furniture, software or an invention. Certain distinctive signs such as trademarks and geographical indications also belong to intellectual property. The holder of a material property (for example, a book copy) does not necessarily have the intellectual property right for this material. As the owner of a book, you can read it, colour in it, throw it away, etc. but you do not have the right to copy the story, reproduce it, put it on the internet, make a film of it, etc. These latter acts are covered by intellectual property and require the consent of the holder of the intellectual property rights concerned.
A copyright holder for a book (note: not for the physical book but the intellectual/immaterial content) is the only person who can reproduce or market it.

Similarly, a patent holder for an invention is the only person who can exploit this invention (for example, selling a patent-protected medicine). A trademark holder is the only person who may sell the products covered by this trademark (for example, only the holder of the "Côte d'or" trademark may use this sign for chocolate or similar products.

Types of intellectual property rights

Intellectual property rights may be divided into two main categories: industrial property rights and literary/artistic property rights. Copyright,Related rights,Database rights are come under Artistic and literary property and Patent rights,Trademarks, Design rights, Plant variety rights, Geographical indications are come under Industrial property right. For More Detail I have reffred this Link

1.Patent:-A patent is issued to protect an invention. It gives the holder the right to prevent anyone from making, using or selling the patented invention for a fixed time period.

2.Copyrights:-A copyright protects artistic and literary work. The holder has complete rights and control over adaptation or reproduction of the work. Copyrights last for up to 70 years after the innovator’s death.

3.Trademark:-Trademarks are distinctive phrases, words, symbols or signs. They distinguish services or products of one company from the others. Brands usually associate with distinctive trademarks.

4.Design:-A design protects the outward appearance or the visual style of an object. It does not protect unseen design elements of the product.

5.Database :-Database right is similar to copyright. It prevents copying of significant sections of a database. The database right protects the information itself and not the form of information.

6.Trade Secret :-A trade secret is a practice, design, formula, process or a compilation of information. This information is utilized by a company to gain competitive advantage over the others.

Creative Commons License(CC)

The various types of Licenses are availble for the project, First I have Understand about its various types and how to create the your own license for work completed by you.for that

For my project, I prefer an open source license, to give an opportunity to share the knowledge I gained, and open a path for further developments.the name of Creative Commons to give the users more option to protect their rights when they publish on the internet.

Following are the different types of licenses

1. Attribution (CC BY) This license lets others distribute, remix, tweak, and build upon your work, even commercially, as long as they credit you for the original creation. This is the most accommodating of licenses offered. Recommended for maximum dissemination and use of licensed materials.
2. Attribution-ShareAlike (CC BY-SA) The same as previous attribution license, additionally all new works based on your work will be under the same license, also it allows commercial use.
3. Attribution-NoDerivs (CC BY-ND) This license allows for redistribution, commercial and non-commercial, as long as it is passed along unchanged and in whole, with credit to you.
4. Attribution-NonCommercial (CC BY-NC) This license lets others remix, tweak, and build upon your work non-commercially, and although their new works must also acknowledge you and be non-commercial, they don't have to license their derivative works on the same terms.
5. Attribution-NonCommercial-ShareAlike (CC BY-NC-SA) This license the same as previous(CC BY-NC), but other users of your work should credit you and license their new creations under the identical terms.
6. Attribution-NonCommercial-NoDerivs (CC BY-NC-NO) This license is the most restrictive of our six main licenses, only allowing others to download your works and share them with others as long as they credit you, but they can't change them in any way or use them commercially.
